ह्या निर्मिती/कृतीचे प्रताधिकार(कॉपी राईट)-कालावधी लोप पावल्यामुळे अथवा भारतीय कायद्यांच्या अधीन प्रक्रीयेने प्रताधिकार मालकाने स्वतः तसे उद्घोषित केल्यामुळे भारत देशात हि निर्मिती/कृती सार्वजनिक स्रोत(बौद्धीक संपदा) ठरते.
भारतीय प्रताधिकार कायदा भारतात प्रथम प्रसिद्ध निर्मितीस लागू होतो, भारता बाहेर प्रथम प्रसिद्ध झालेल्या कृती सुद्धा इतर बौद्धिक संपदा आणि एकस्व विषयक कायद्यांच्या अधीन पुर्नउपयोगापासून भारतात संरक्षित असू शकतात.
भारतीय प्रताधिकार कायदा ,१९५७(Chapter V कलम २५) अनुसार, अनामिक निर्मिती, छायाचित्रे, चलचित्र व तत्सम कला, ध्वनिमुद्रणे, शासकीय निर्मिती आणि खाजगी उद्योग-आस्थापना किंवा आंतरराष्ट्रीय संस्थांनी निर्माण केलेली कृती प्रथमप्रसिद्धीच्या तारखेपासून पुढे साठ वर्षांनंतर सार्वजनिक संपत्ती ठरतात, ही मोजणी ६०व्या वर्षानंतरच्या येणार्या नवीन calendar वर्षाच्या आरंभापर्यंत केली जाते. (उदा. 2026वर्षारंभा पासून, १ जानेवारी 1966 पूर्वी प्रसिद्ध किंवा निर्मित कृती या सार्वजनिक स्रोत (बौद्धीक संपदा) समजल्या जातात). मरणोपरांत प्रकाशित-(वर नमुद केलेल्या कृतींशिवाय इतर)-झालेल्या कृती प्रकाशन तारखे पासून ६०व्या वर्षानंतर सार्वजनिक स्रोत(बौद्धिक संपदा) म्हणून गणल्या जातात. इतर कोणत्याही प्रकारची निर्मीत कॄती निर्मात्याच्या देहांता पासून ६०व्या वर्षानंतर येणार्या नववर्षापासून सार्वजनिक स्रोत (बौद्धिक संपदा) बनते. कायद्यांचा मजकूर, कोर्टाचे मत/निवाडा, आणि काही विशिष्ट शासकीय अहवाल प्रकाशित झालेल्याक्षणी प्रताधिकारमुक्त असतात.
